Business Immigration Program
Canada Immigration

Canada is often called a land of opportunity. There are three main sub-categories in the Business Immigration Program in Canada: Entrepreneurs, Investors, and Self-Employed Immigrants.

Immigrate to Canada under the Entrepreneur Program: You may be able to immigrate to Canada if you can demonstrate that you have the ability to establish, purchase, or make a substantial investment in a business in Canada that will create employment opportunities for a Canadian citizen or permanent resident, other than yourself or your dependants. If you have the appropriate business experience, adequate net worth, and meet the specific selection criteria, you may qualify under the Entrepreneur Program to apply for permanent residence status in Canada.

Immigrate to Canada under the Federal Immigrant Investor Program: Under this program, an applicant must first meet the definition of investor. To qualify as an investor one must have the requisite business experience, a legally obtained personal net worth of $1.6 million CDN, and provide a written statement of one’s intention to invest $800,000 CDN in Canada. What constitutes business experience is defined by legislation. Upon meeting the definition of investor, an applicant is assessed on a selection grid. Out of a possible 100 points, an applicant requires a minimum of 35 points. Points are awarded based on business experience, education, age, official languages, and adaptability. In addition to the above, there are other requirements which must be met such as medical and security requirements. A permanent resident visa will only be issued if the applicant meets all requirements and after the deposit of the $800,000 CDN investment is received by Canada. Citizenship and Immigration Canada manages your investment, which is guaranteed by the Provinces that use it to fuel their economy. Approximately five years after your investment is made, it will be returned to you, without interest.

Immigrate to Canada under the Self-Employed Persons Program: Under this program, applicants will either have experience that makes a substantial contribution to the cultural or athletic life of Canada or experience managing a farm and will purchase and run a farm in Canada. Applicants under this category may apply for permanent residency if they possess the requisite experience, meet specific selection criteria, and pass medical and security requirements.

Whether you are an Investor, Entrepreneur, or a Self-Employed person, our law firm can assist you in applying for permanent residence status under the Business Immigration Program in Canada. At Velletta & Company our Immigration Department works with our Corporate Team to ensure that in addition to your immigration needs being met, your corporate needs are as well.

Temporary Foreign Workers
Canadian Visas & Work Permits

Work permits / visas are likely required to work in Canada, unless you are a Canadian citizen or permanent resident of Canada. There are several occupations, however, that do not require a work permit. Regardless of whether or not you require a work permit, you may still require a temporary resident visa to enable you to visit Canada.

Generally, prior to submitting an application for a work permit, your employer must first apply for and obtain, through Human Resources and Social Development Canada (HRSDC), a Labour Market Opinion (LMO). The HRSDC requires that LMO applications include proof of recruitment efforts, among other things. There are specific advertisement requirements, which must be adhered to, unless an exception to the advertisement requirements applies. Velletta & Company can assist with the LMO process.

Once a positive LMO is obtained we work with you to prepare your application for a work permit. We will also assist you by preparing your application for a temporary resident visa, if required.

Whether you are applying for a work permit or an employer looking to hire a foreign worker, we can help.

Sponsoring your Family
Immigrating to Canada under the Family Class (Sponsorship)

Canadian citizens or permanent residents may be eligible to sponsor certain family members to become permanent residents of Canada. You may sponsor your spouse, common law partner, or dependent children as members of the family class. In addition, you may also sponsor other relatives such as parents and grandparents.

At Velletta & Company we will work with you to determine your eligibility as a sponsor and that the family member you wish to sponsor is eligible for sponsorship under the family class.

We would be pleased to meet with you to discuss your options and provide you with detailed advice on sponsoring your family to become permanent residents of Canada.

Skilled Workers
Canadian Immigration Requirements

In Canada, the Skilled Worker category incorporates a points system. To qualify as a Skilled Worker, not only must you have the requisite skilled work experience, you must also have sufficient points. Points are awarded based on personal skills, education and other characteristics, such as adaptability.

Recent changes to processing Skilled Worker applications require that applicants either have a valid offer of arranged employment or the requisite skilled work experience in one of 29 eligible occupations. In addition, all applicants are now required to submit results of a language proficiency test, regardless of whether their first language is English or French.

Canadian immigration lawyers work with you to determine your eligibility under the Skilled Worker category.
